Corpus Christi couple files lawsuit against Toyota

CORPUS CHRISTI ? A Corpus Christi couple on Friday filed a lawsuit against Toyota Motor Corp. citing a collision the family blames on their car’s accelerator. The petition, filed in Corpus Christi federal court, seeks class-action status.

Sylvia R. and Albert A. Peña filed the lawsuit on behalf of themselves and others who might have suffered as a result of accelerator issues found in some the Japanese maker’s vehicles. Zoe Zeigler, a Toyota spokeswoman, said the company does not comment on pending litigation.

Albert Peña said he was driving his 2008 Toyota Avalon when the vehicle accelerated unexpectedly at a stop sign, causing a collision, according to court documents. Most recently, Sylvia Peña was driving the car when it suddenly and unexpectedly accelerated while attempting to slow down to make a turn, the documents allege.

“Before that, we hadn’t heard about problems with the accelerator,” Peña said. “I heard about it later when I was traveling. We just request justice and want Toyota to be held accountable.”

The plaintiffs request compensatory damages, punitive damages and reasonable attorney fees. As of Monday morning, Toyota had not filed a response.
